New Labor Law: An Offer Letter is Required for Student Employees

Effective October 26, 2009, pursuant to Section 195(1) of the New York State Labor Law, employers are required to give written notice of the rate of pay, the hourly overtime rate of pay (if applicable), and the regular payday to employees upon hire. The new law also requires employers to obtain a written acknowledgment from each newly hired employee that they have received the required information. The requirement does not apply to appointments begun prior to October 26, 2009.

This new labor law applies to all offers of employment, including exempt positions (regular, term, temp, and casual), nonexempt positions (regular, union, term, temp, and casual), and student positions.

A separate offer letter is required for each different job title and pay rate a student employee is offered.

To ensure compliance with the new regulations, you may use the template of the student employee offer letter provided below. If you would like to include additional job-specific requirements or expectations to the letter, you may edit it as needed, as long as the original information remains in the final version signed by the student.

Departments are responsible for the entire offer letter process -- completing, signing, obtaining signature from the student, providing a copy to the student, and keeping a copy on file at the department level.
